Magistrate Urges Police Prosecutor

Magistrate Dr. Abou Bakarr Binneh Kamara of Siaka Stevens Street Magistrate Court No.1 in Freetown yesterday in a very angry mood urged the Sierra Leone Police Prosecutor to produce their factual witnesses in the alleged murder case involving an accused, Lamin Sesay alias Humback.

The urge came about when the matter was mentioned in Court, and a police formal witness was produced to testify in the matter.

The police formal witness was refused to give evidence by the said Magistrate but ordered the prosecution to produce their factual witnesses on the next adjourned date.

According to Magistrate Dr. Binneh Kamara, since the start of the matter in March 2017, no single witness had ever testified in Court and the accused has been on remand without bail.

This according to Dr. Binneh Kamara is unfair to the accused person and the court based on the seriousness of the offence, as the formal witness evidence will not meet the threshold for the matter to be committed to the High Court for trial.

The accused person is arraigned in Court on a Preliminary Investigation of murder contrary to law.

The particulars of offence state that the accused in March 2017 alleged to have murder a Sierra Leonean citizen in Freetown.

Defense Counsel, Lawyer Sahid Mohammed Sesay said the prosecution should have complied with Section 118 of the Criminal Procedure Act for proper trial of the accused person.

The police prosecution in responding to the Court order alleged that the accused is answering to another in the High Court, but assured the Court to present the factual witness on the next adjourned date.

The matter was adjourned to the 19th July 2017 for the factual witness to give evidence in the matter.
