Mohamed M’baqui To Be Tried By Judge Alone

The State Counsel in the alleged conspiracy to defraud involving Mohamed M’baqui and Mohamed Sesay and an Indian victim opened at the High Court of Sierra Leone before Justice Alusine Sesay yesterday.
State prosecuting Counsel, M. B. Davies made an application that the said matter be tried by Judge alone rather than trial by jury. This application was made under section 144 sub-section 2 of Chapter 32 of the Criminal Procedure Act of 1965 as repealed and replaced by Section 3 of the amendment Act 11 of 1981.
The matter which had since been presided over by Justice M. A. Paul has been transferred to Justice Alusine Sesay for trial as the former Judge, Justice M .A .Paul’s contract with the Commonwealth was not renewed. The matter according to proceedings will start all over again at the High Court before Justice Alusine Sesay.
The two accused were early this year arrested and charged to court on various offences ranging from conspiracy to murder contrary to law, conspiracy to defraud, obtaining money by false and other related charges contrary to law.
The application for the matter to be tried by Judge alone was not objected to by the defence counsel, F. B. Kelfala who asked for an adjourned date for further proceedings.
Justice Alusine Sesay in his ruling granted the application but stood down all the jurors in the matter. He admonished both counsels to be committed in expediting the matter.
The matter was adjourned to the 15th December 2014.
