T.J. Freeman, the State Counsel representing the State respondent in the Commission of Inquiry (COI) Appeal case of former Ebola Coordinator, Mr. Steven Gaojia has conceded to the appellant’s grounds of appeal dated 12th October, 2020 and Lawyer Osman Jalloh`s synopsis dated 22nd July 2021.
Lawyer Osman Jalloh, in his oral arguments yesterday before the Court of Appeal abandoned Grounds 1, 2 & 3 of the Appellant`s appeal and submissions contained in Pages 1 to 18 of the synopsis filed.
Appellant’s Counsel, Osman Jalloh relied on Ground 4 and submissions on Pages 18 to 44 of his synopsis filed to the court and the State respondent.
The Presiding Judge, Justice Ansumana Ivan Sesay said the Sole Commissioner, Justice Biobell Georgewill failed to take into consideration a vital document before reaching his conclusion. He noted that if the Commissioner had taken that document into consideration he would not have reached the conclusion of an adverse finding.
The appeal case of Steven Gaojia was yesterday unanimously allowed by three Appeal Court Judges including Alhaji Momoh Jah Stevens and Adrian Fisher with reasons to be given later.
The appellant was a Person of Interest before the COI as established by Constitutional Instrument No.64 of 2018.
