The alleged sexual penetration matter against the former Leader and Chairman of Alliance Democratic Party (ADP), Mohamed Kamarainba Mansaray and co-accused, Marion Lamin Arouni will again come up today, 1st September 2022 for hearing of second accused person, Marion Arouni`s testimony in defense.
The two accused persons will make appearance at the Sexual Offences Model Court on main Law Court Building, Siaka Stevens Street, before Justice Samuel Omodale Taylor, a High Court Judge sitting in Freetown.
After several bail applications made by defense counsels, the trial Judge, Justice Taylor considered the application thereby, granting bail to the accused persons.
The accused persons were in 2021 granted bail in the sum of One Hundred Million Leones (old note) each, two sureties to produce a title deed in Western Area; and with both accused persons to surrender their travelling documents including Passports.
Marion Lamin Arouni fulfilled the bail condition imposed by the court, while the first accused person, Mohamed Kamarainba Mansaray is yet to surrender his United States of America (USA) Passport.
Mr. Mohamed Kamarainba Mansaray, the 2018 Presidential Candidate of ADP, is still on remand at the Pademba Road Maximum Male Correctional Centre in Freetown while he is attending court.
At the close of the prosecution case, lead Defense Counsel Emmanuel Saffa Abdulai led Mohamed Kamarainba Mansaray and his witnesses in evidence, and in defense of the allegation before the court; while Marion Lamin Arouni was to open her defense today.
Mohamed Kamarainba Mansaray and Marion Lamin Arouni are jointly answering to seven counts criminal charges, sexual penetration which the first accused, Mohamed Kamarainba Mansaray is charged alone, conspiracy, to aiding and abetting contrary to law.
In the particulars of offence, the State alleges that Mohamed Kamarainba Mansaray in the year 2020 sexually penetrated a 15-year-old girl, and a Junior Secondary School (JSS3) pupil who was staying with her Aunt, Marion Lamin Arouni in Kono.
It would be recalled that the accused Mohamed Kamarainba Mansaray was incarcerated since his arrest in the year 2020. During the trial, the Judge granted bail but unfortunately for Mr. Kamarainba he was unable to fulfill the bail condition which would have granted him partial freedom. Being unable to meet the bail condition has kept him in remand.
