High Court Judge sitting in Freetown on Main Law Court Building on Siaka Stevens Street, Justice Aiah Simeon Allieu has refused to grant an interim injunction against the conduct of the Bureh Chiefdom Paramount Chieftaincy (PC) election held on 20 July 2022.
The decision of the Court was based on an application filed for the granting of an interim injunction preventing the conduct of the said chieftaincy election in the Port Loko District, in the Northwest region.
The application before the Court was filed by K&K Partners on an experte notice of motion dated 14 July 2022, on behalf of the Applicant, Patrick Mohamed Kamara against the defendant’s respondent, Alex Sorieba (Provincial Secretary), Electoral Commissioner, and Daniel Moray Kamara.
The above application was moved in Court by Lawyer Mohamed N. Kamara on 19th July 2022 seeking an injunction.
Counsel submitted that the Applicantโ€™s matter required urgent attention and that they were right before the Court.
Patrick Mohamed Kamara was disqualified to become a Chief by the Provincial Secretary, Alex Sorieba at a declaration of right meeting held at the Mange Bureh Court Barray on 6th July 2022.
After hearing the application, Justice Aiah Simeon Allieu ruled that the application was untimely and could not be complied with according to the Provision of the Paramount Chieftaincy Act of 2009, especially Section (18) sub-section (1); which states the time and manner in which one should approach the Court to challenge the validity of an electoral process.
The presiding Justice, Aiah Simeon Allieu struck out the application on the grounds of timeliness as the election is expected to be held on 20 July 2022, after hearing the matter on 19 July 2022.
