Le366M Missing At Medical Enterprise… 2 Officials Docked

The alleged financial defalcation at Dyna Lab Sierra Leone of Three Hundred and Sixty-Six Million Leones has landed the Operations Manager, Mohamed Suluku Kamara and Sales Person, Zainab Mansaray in court.

The said matter was first reported at a Police Station in Kono district by Mohamed Suluku Kamara against Zainab Mansaray and after police investigation, Madam Zainab Mansaray of Dyna Lab Medical sales agent in Kono and Waterloo respectively, was charged to court a one count preliminary investigation.

During her first appearance at the Kono Magistrate Court, Zainab Mansaray was refused bail and remanded with her two-year-old child, and after serving ten days on remand, she was granted bail following a bail application made by defense counsel, I.F.Mansaray after crossed examination of the complainant, Mohamed Suluku Kamara.

Mohamed Suluku Kamara, complainant in the matter in Kono was later arrested and charged to court. He is now before Principal Magistrate, Sahr Keikura at the Pademba Road Court No.1 as an accused person, answering to a criminal charge of embezzlement, contrary to the Larceny Act 1916.

The particulars alleged that the accused person, Mohamed Suluku Kamara on diverse dates between the 1st April and 30th June 2021 in Freetown, being an employee of Dyna Lab Sierra Leone Limited, fraudulently embezzled the sum of Two Hundred and Forty- Four Million, Eight Hundred and Ninety Nine Thousand Leones, being proceeds from sales of standardized medical herbs and nutrition supplements.

Sahid Mohammed Sesay, a private legal practitioner is prosecuting the accused person, Mohamed Suluku Kamara on a fiat application granted by the Director of Public Prosecution (DPP).

The prosecution Lawyer, Sahid Mohamed Sesay was yesterday before Justice Mohamed Bawoh on an application by way of an originating notice of motion dated 17th September, 2021 on behalf of the applicant Zainab Mansaray.

On the face of the originating notice of motion, Lawyer Sahid Mohammed Sesay prayed for the following orders that the criminal matter between the Inspector General of Police as complainant and Zainab Mansaray as accused person for the said matter, now pending before the Magistrate Court sitting at Kono, be transferred to the Magistrate Court No.1 sitting at Pademba Road for further hearing and determination.

And that the bail granted to the applicant herein, Zainab Mansaray by the presiding Magistrate at Kono, be made to continue upon the terms set out by the said Magistrate Court or upon such terms as the High Court shall allow; and that the High Court do fix a date of commencement of further hearing of this matter before the Magistrate Court No.1 sitting at Pademba Road in Freetown.

According to Lawyer Sahid Mohammed Sesay, he relied on the entirety of both Zainab Mansaray and Sesay affidavit sworn to on 17th September 2021, particularly paragraph 1 to 9 of applicant affidavit and paragraph 3 to 9 of his own affidavit.

The affidavits is supported  with the following exhibits attached to, including copy of charge sheet against Madam Zainab Mansaray before the Kono Magistrate Court, copy of the charge sheet against complainant which is before the Principal Magistrate No.1 in Freetown and copies of medical report in respect of the applicant.

He further applied for both matters to be put before the Principal Magistrate sitting at Pademba Road Court in Freetown.

Lawyer S.M. Sesay made the application, pursuant to the provisions of Section 10b of the Court Act No.31 of 1965 and Section 79 (3) and (4)  of the Criminal Procedure Act No.32 of 1965 as amended.

Justice Mohamed Bawoh adjourned the matter for ruling today, 28th September, 2021.
