“I cannot fault you for your absence at the Locus visit at the Sierra Leone Mission Chancery Building in New York conducted on the 23rd and 24th March, 2023, and I will not hold you for contempt due to your conduct since the inception of the matter; but whatever might have been the cause, I advise that in future you have to check, fact-check and double check so you are assure of what to do and what not to do,” Justice Adrian Fisher admonished the forth accused Dr. Samura Mathew Wilson Kamara, the 2023 Presidential candidate for the main opposition All People’s Congress (APC).
Responding to Justice Fisherโs question as to why he (Kamara) was absent at the Locus visit, Dr. Samura Mathew Wilson Kamara said he was present in New York, but physically absent at the building site based on the option in Order 3 of the Court Orders with regards to the Locus visit.
According to Justice Adrian Fisher, the reason for the absence of the forth accused was not the spirit of order 3, and prior to the Locus visit, the Court order was for those that are unable to travel to New York to be represented by their Counsel.
The travel documents that the Court released to the forth accused Dr. Samura Kamara were based on his intention to travel for the Locus visit and for him to make himself available at the Chancery Building site.
The absence, according to the lead defense counsel of Dr. Samura Mathew Wilson Kamara, Lawyer Franklyn Bai Kargbo was not out of disrespect for the court, but for circumstances that cannot be said in open court. “I apologize on his behalf if constrains were not explained”, Lawyer Franklyn Bai Kargbo said.
Records of the Locus visit in New York, United States of America were taken, transcribed into a report and read by the Senior Registrar at the Anti-Corruption Commission Court (ACC) Mr. Alpha Ann Kanu.
The defense team has made a recall for the second prosecution witness Paul Bockarie for clarification and cross examination with matters arising from the Locus visit.
Lawyer Franklyn Bai Kargbo also called for the 17th and 18th Prosecution witnesses including Dr. Alie Kabba, but the Judge asked Frank Kargbo to file an application and serve to the ACC and the court latest on Wednesday 5th April 2023; which is also the adjourned date for hearing.
